Defense Verdict in Perry County Medical Malpractice Trial

Kinkead & Stilz is pleased to announce that David Latherow and Dustin Haley, with the support of paralegal Lisa Smith, obtained a defense verdict on behalf of two cardiologists in Hazard, KY.

The case alleged the cardiologists failed to exercise the degree of care and skill expected of reasonably prudent physicians, resulting in a pacemaker infection and the patient’s death. Plaintiff sought damages in excess of $10,000,000.

Over the course of a seven-day trial in Perry County Circuit Court, David and Dustin presented clear and compelling evidence that the cardiologists met or exceeded the applicable standard of care at every stage of the patient’s treatment. The jury returned verdicts 11-1 on the standard of care for both physicians.

David and Dustin continue to build on their strong record of successfully defending physicians and other healthcare providers throughout the Commonwealth.
