Kinkead & Stilz is pleased to report that Melanie S. Marrs recently achieved a unanimous Defense Verdict for Baptist Health Corbin in a case tried for two weeks in Whitley Circuit Court. The allegations against Baptist were that they failed to appropriately potassium as required by a standing protocol and that her cardiac event was caused by a combination of low potassium and the Levaquin. The case was defended on behalf of the hospital on standard of care and causation grounds on the premise that the nurses acted appropriately based on the orders given and that the woman’s cardiac event was unrelated to the prescribed medication. Plaintiffs sought over $50,000,000.
