I find my process rewarding – not just because of the interesting problems to be solved and the people that I meet along the way, but also because it helps clients through to a conclusion. That’s one of the main reasons why I do what I do.

Practical Experience

Trespass, negligence per se, collateral estoppel. Successfully concluded an action in favor of a Fortune 500 company whose pipeline and property had been seriously damaged by a landslide. In so doing, obtained partial judgments for my client against several defendants based upon administrative rulings that collaterally estopped them from re-litigating key issues.

Mineral lease, termination. Assisted clients in terminating a 1956 coal lease paying a meager 25¢ per ton royalty, which resulted in the entry of a judgment in their favor for almost $3,000,000. In the process, was able to favorably resolve claims based upon an alleged wrongful condemnation.

Construction of gas lease, statutes of limitation. Retained to oversee an appeal following the entry of a $2,000,000+ judgment against a gas producer for underpayment of royalties. The Court of Appeals vacated and remanded, which effectively reduced the judgment to a fraction of the original amount

Quiet title, mutual mistake, reformation. Helped a client secure a judgment reforming a deed because of a mutual mistake, thereby quieting title to a tract and the 6,000,000 tons of coal refuse that were deposited upon it.
